Switching Gears - End of an Era

The end of the year is a time to reflect on one's life and legacy.  It is a particularly compelling time, in view of climate change realities becoming more apparent every day, that what we say and do is shaping our immediate future, not just the distant future for grandchildren.

For this reason the end of Stocks & Bond majority reign over Encinitas city government make future plans and our legacy feel more urgent than past election years. This deserves thinking that rises above facile political maneuvering or infotainment or cheap shots borne out of a social culture of marketing. It's governing time, not campaigning time.

Having an arch nemesis like Jerome Stocks turned out to be a rallying point and organizing platform for many in the last election. Even though the new council members Lisa Shaffer and Tony Kranz did not campaign as anti-Stocks candidates, thousands of Encinitas voters were interested in removing Jerome Stocks above all other concerns. Our Mayor blog was created to acknowledge legitimate disgust with Jerome Stocks' behavior as a so-called public servant. The years of city council meetings contained enough clips of this behavior as evidence for the electorate. The idea was that more people needed to be able to witness first hand – via these clips and linked stories, commentaries and some background information – what critics of Stocks had been saying for years.

Whatever factors were involved it is a fait accompli now and time to switch gears. Is it possible we can still capture the motivation the anti-Stocks group had with a formidable problem we all can identify with versus a person or group of people? Can we cultivate an educated electorate unafraid to voice public opinions for fear of seeming stupid or simply wrong? Is it possible to encourage awareness and still identify as a savvy, social being?

It is easy to see from some of the current community voices reacting to the We Love Encinitas organization (and ethically dubious campaign fliers) in the online news posts and one blog's comments sections, Kristin Gaspar is a likely target to transfer anti-Stocks energy. We get it. Our Mayor blog has 3 or 4 dozen examples of Gaspar's behavior along with Stocks or solo that deserve condemnation. No doubt the new year will bring more.

But, this personality focus is really toxic stuff. It too easily morphs into character assassination, body policing, misogyny and other community-killing divisive words. This invites lazy thinking and other vitality sucking habits. Besides all that it brings out our worst rather than our best natures. Critical thinking asks more.

What if we instead switched gears to the three things that repeatedly come up in Encinitas politics as problems or omissions;
1. finance (economy, budget, pensions, etc.),
2. open government (sunshine ordinance, transparency, civility, accessibility, etc.)
3. environment (land use, community character, resources, climate change)
4 traffic (could fit in environment, but some very big issues ahead need deliberation)

Let's demand of this new council – so they in turn will demand it of city manager and city attorney and city staff – a clear direction of where we are going in any of these areas. Not only must we insist on this, we should demand comprehensive research, comparisons to other cities and emerging trends from our well paid staff. Let's demand that deliberations by the council be more than unsupported platitudes, rambling monologues, throwing out a bunch of buzz words, personal memories, rehearsed staff exchanges and other time-wasting talk.

They will make mistakes, council and staff alike. We will find some council members and city employees lacking at any given time. Hell, we'll continue to have community members who annoy us. We will disagree. This editor will try to catch the kinds of things that illustrate dissent and controversy. This isn't a good news, community events calendar, party line place. Our city government's corruption and incompetence demands vigilance. We don't have to make things up. Video clips, quotes, news coverage and the whole works will apply. The former super majority clearly served the few of their overlords. There is a new game in town. The mandate is genuinely from the majority of our community so there are more eyes watching.

And, if a blogger can be allowed to dream. Just imagine a city council becoming relevant to the disengaged, the young, the non-white people, the renters, the low income residents of Encinitas. It is a myth that when all people enjoy a higher quality of life and feel security and engagemed it means something is diminished from another's quality of life. If this new city council wants continuous improvement, they should think big.

Guess Who Loves Encinitas?

The recent news of the Gaspars being the ones behind the We Love Encinitas fliers, using the taxpayer funded Citizen Satisfaction Survey as a campaign device to promote Jerome Stocks and Mark Muir (dismal failure) prompts another question.

Why was Teresa Barth left off the 2nd mailer? She obviously loves Encinitas too. The following clip is from the Sept. 12, 2012 meeting when the True North consultant responsible for the Citizen Survey was questioned about the results.  It is worth watching the entire meeting with the advantage of knowing that the intended use in the campaign was a foregone conclusion for the council majority, the consultant if not the city manager.

It was clear several days before the election that the clumsy attempt to sway voters with Gaspars' We Love Encinitas mailers was doomed to failure.  The fliers and the sneering comments against Candidates Shaffer and Kranz and their supporters being the 2% who didn't love Encinitas insulted people's intelligence and sense of basic ethical standards.  

Despite the above clip, we heard that Paul Gaspar claims Teresa Barth indicated she didn't love Encinitas.  This isn't a direct quote as this blogger had to hear it on the grapevine.  But, it was so patently a lie and downright slanderous something needed to be said.  These twisted kinds of defense will only continue to poison the council's environment.  And that is indefensible. The new majority won't stand for it. 

And just one more clip to remind us what the current majority had to say about the survey when it was proposed March 28 of this year.

Note how Barth attempts to follow through on Bond's critique of a survey in an election year and she is cut off by our Mayor Stocks.  Deputy Mayor Gaspar uses the city manager as fall guy technique to force the vote.  She has used this bullying before with Gus Vina here and here. (Hopefully, this blogger won't be the only one crying foul if she continues with this in the upcoming year.)

A word about the whole point of the Citizen Satisfaction Survey.  So, presumably it was for the new City Manager, Gus Vina, to get information.  He defends it after the fact in his November newsletter, dated the same day Marcos Gonzalez of Coastal Law Group released the search results for the We Love Encinitas records.

The irony du jour is that there is a 6 pm public meeting tonight, Nov. 27, at City Hall on the Hall Property Park with only the most vague description on the city website. News of this via Patch appeared early today or late last night only because Councilwoman Barth saw it on the city website and alerted the press.

Doesn't that perfectly illustrate Barth does love Encinitas and goes above and beyond without grandstanding?  If the city manager will check out the citizen responses to city communication in the now infamous Citizen Satisfaction Survey, it would be clear to him that posting on the website alone isn't very effective.  City Manager Vina, please try harder to be a real ally serving Encinitas citizenry.  Continuous improvement . . . amirite?

Who was behind the We Love Encinitas Deceptive Mailer?

Last October 7th people were passing out this flyer at the annual Olivenhain Oktoberfest.   People were outraged that the taxpayer funded Citizen Satisfaction Survey had been manipulated to serve as propaganda for Stocks campaign.

On Oct. 12 Encinitas Undercover posted the background on the mailer after the widespread delivery of this piece to people's homes.  

"Think about that: Jerome Stocks' backers are getting tax deductions for sending out what are, for all practical purposes, campaign mailers.  I suspect the IRS will frown on this charade and those involved will face legal consequences.  But even if not, what was Stocks thinking?  On the heels of sign-gate, to serve up another prime example of cutting corners and bending or breaking rules for political gain?  How much more blatant could he be in validating the complaints of his harshest critics?"

Yesterday we learned that the person responsible for the mailers via the Secretary of State database thanks to Coastal Law Group responding to inquires for information.

So, it isn't listed here whether this a non-profit or 501(c)(3).  What is significant beyond the staggering arrogance of Paul Gaspar, Deputy Mayor Kristin Gaspar's husband, is the date of activation on Oct. 22 being two weeks after the date when the misleading campaign piece was widely distributed.

Is it stupidity, naiveté or as stated, staggering arrogance, to disregard laws so blatantly? It isn't like this family hasn't already been challenged and failed on this front.  Before it was the deceptive slate mailers.  Early in October Councilwoman Barth wrote a commentary reminding citizens to be ready for the October Surprise of hit pieces via the mail. This was cross posted at EYNY.

"Slate mailer companies are also used by various individuals to send out last minute "hit pieces" on candidates. By using a slate mailer the actual contributors can remain unknown until after the election when the contribution reports are filed with the FPPC. These companies also provide a means for contributors to, legally and illegally, circumvent local campaign contribution limits.

In the 2010 election, the Voter Education Group sent out a mailer endorsing candidates Kristin Gaspar and Dan Dalager and blasting me. The group was later fined more than $110,000 by the FPPC for various state-wide financial reporting violations.

It's not illegal to pay for a slate mailer endorsement but is it ethical?"

This is the pressing issue for Encinitas citizens and for the new City Council, what does Deputy Mayor Kristin Gaspar have to say about her husband's exploitive use of the taxpayer funded survey and corporation creation?  We don't know all of the legal issues or ramifications, but we can uncover right now what the ethical issues are.

Yes, We Have a Winner

The winner is Encinitas Guerilla with our thanks for coming up with this. Kristin Gaspar couldn't have a more fitting title.  On this one you hit it right (whoever you are). This one is going to stick.

"Princess Narcissus Gaspar cited her heels and roller skating in Yucaipa, which all saw as natural and appropriate reasons to oppose the bureaucrats’ proposal."

No roller skating photos for the recent Skatepark / Dog Park / Hall Park ground breaking.  Princess Narcissus dresses herself to dig at the groundbreaking, wearing platform heels and a shiny mini skirt - as you do. We know about the shiny smiles, shiny clothes and shiny shoe thing from observation.

Outfitted like this, it's a fitting metaphor of "look at me, look at me" instead of judgement for the requirements at hand.  It isn't just wardrobe.  It is words and behavior too.

I thank you for your recent email regarding positive environmental policies.  I share your views as does the Council, who have voted unanimously on numerous environmental issues to protect or improve the conditions in Encinitas. During the past year and a half this includes, but is not limited to:

• Environmental Action Plan- I led the discussion and developed consensus on a plan which included objective measures, so that staff could deliver maximum results for the taxpayer dollars. This plan passed unanimously, including aye votes from Maggie Houlihan and Teresa Barth.  July 20, 2011 

At the Feb. 16, 2011, Councilwoman Barth made the motion, and Maggie Houlihan supported it, to approve the Action Plan as presented by the Commission. Jerome Stocks was particularly insulting to Elizabeth Taylor, the commission chair who made the presentation. 

Barth withdrew the motion and requested the item be brought back at a later date for additional discussion. At the July 20, 2011, Gaspar proposed eliminating many of the stronger proposals preferring minimal compliance.  Houlihan and Barth were able to include some items previously eliminated creating a compromise (admittedly weak but better than the complete gutting) that we could all support. (see minutes  listed in the Aug. 17 meeting)

• Solar Panels- The Council voted unanimously, including Councilmember Muir, to oppose SDGE's unfair rate hikes on users of solar panels, who actually provide all citizens a benefit by producing more energy than they expend. Jan. 11, 2012  

At the Nov. 16, 2011 meeting, Barth asked to have the issue SDG&E’s proposed solar users rate changes be placed on a future agenda. On Jan. 11, 2012  the issue was discussed with local solar companies and numerous public speakers  asking the council to send a letter of opposition. Encinitas was one of many cities and thousands of rate payers that opposed the hike. 

• Electric Car charging station- I proposed that the city reduce or waive the fees for installing these stations before I was elected to Council. Recently, Mayor Jerome Stocks put this item on the agenda and it passed unanimously.  

Electric car charging stations: the one located in Encinitas is part of a state-wide effort and is a joint project with the city. No fees would have been charged to install this station. The recommendation to reduce or waive permit fees to install home solar panels and charging stations was a prior recommendation of the Environmental Commission. ...can’t find the meeting urgh. It was also already common practice in other cities. 

• Farmers Market- Approved unanimously (5-0) after being put on the agenda by the Mayor and City Manager. 

The Farmers Market issue was brought to the council on Feb. 15, 2012 by the Planning Dept. as they were recommending that the city charge a fee to use the public parking lot. Gaspar pursued an aggressive line of questioning if those fees were set high enough.  The agenda item was NOT initiated by the Mayor only a procedural requirement.

• General Plan- Since my election, I have worked harder than any other Councilmember to oppose increasing density along the El Camino Real and Encinitas Blvd corridors. I asked the Council to join me in declaring the land use and housing element of the General Plan officially 'dead'. Again, consensus was developed in a 5-0 vote, and I continue my persistent efforts to make sure those elements do not reappear. 

At the July 18, 2012 council meeting Kristin said staff could use both the Housing Element and Land Use element along with all other elements of the draft General Plan for reference, excepting only the proposals for El Camino Real corridor, Encinitas Blvd. & Santa Fe Dr, when the staff  creates a new draft document. Sounds like she partially resurrected both elements. 

• Protecting natural wetlands- The council supported staff's rejection of a recent Caltrans proposal to enlarge the Interstate 5 ramps at Encinitas Blvd, which would have destroyed a protected wetland. 

Staff and Caltrans have been working on these plans for years. At the Aug. 15, 2012 meeting, Tony Kranz asked why there was not going to be a four-leaf clover design at Encinitas Blvd. The Mayor noted that the area just east of the off ramp was classified as wetlands and Caltrans did not want the extra expense of mitigation. 

The interchange is a Caltrans project and the city council has no authority to approve it or not. At the same meeting, Jerome Stocks mockingly described the area as a wetland...he certainly didn’t sound like he thought the area was worth protecting.  In fact, both Jerome and Kristin were on record supporting Caltrans proposal to widen I-5 significantly through Encinitas. 

Though we have accomplished a lot we can still do more.  We continue to retain the services of an environmental consultant who is pursuing further environmental improvements with the Environmental Commission, at the unanimous direction of the Council.

Please feel free to make an appointment to meet with me at City Hall to address any further concerns you might have.  I do realize that this is an election year and I choose to address citizens concerns in the open, instead of leading from behind.  Misconstruing the voting record and/or views of fellow council members, as Council Member Barth did in her recent email, is counterproductive and is certainly not the best  way to generate a consensus for positive environmental changes.

Truthiness Team's Environmental Lite

New feature at Our Mayor based on the tendency for the council majority take a nugget of truth from a gravel strewn, meandering dirt path towards their own personal and political agendas and hold it up like a prize. Little factoids can be found and spun into stories to delight backers and base. 

Truth is, Stocks and his dance partner Gaspar do not advocate for a smarter, greener Encinitas to be a leader in low-carbon, low-water and low-waste policies and practices. For several years the showboating for solar panels and charging stations (great options) and his shiny Nissan Leaf is about ostentatious toys for the "I'll show you mine, it's bigger than yours" club.

Conservation, innovation and alternatives? Not so much. Marketing is the whole package. Stocks' cluelessness can be astounding.  Salting the earth?  Not to worry. Round-up? It's safe. The goal appears to be keeping expectations as low as possible, no risks, no local funding, demand nothing of developers, ignore several years of study and keep mouthing truthiness. By all means don't ponder the future and the realities that lie ahead.

This meeting was a little over a year ago and five months after Gaspar (in a more scripted, word-filler version than Stocks) all but killed the Environmental Work Plan that had been in the works for a couple of years and intended to be a work in progress guide.  They did achieve their goal of putting crony Alice Jacobs, unquestionably the most unqualified candidate ever to apply on the Environmental Commission. Only having the presence of Teresa Barth and Maggie Houlihan helped salvage some of the Environmental Commission's resolutions.  Here, in the July 2011 meeting she asserts the victory of a "shell" plan like it is a point of pride. This past week it appeared more stalling and deconstructing were the goals in rejecting the staff / commission recommendation.

It is particularly prescient though for being a precursor to the gutting, killing and reworking the General Plan Update to her overlords' specifications. As much as the public and Councilwoman Barth, candidates Shaffer and Kranz have acknowledged genuine concerns from the community regarding their right to have input - the right to address development - we question Gaspar's motives and processes.  Most salient to the red herring of funding concerns above we will continue to ask the question, how much has it cost to gut years of staff time work, workshop expenses, inventing new groups and staff time to implement?  Who's driving and where are they headed? 

Neither Stocks or Gaspar have offered any vision for the future for Encinitas environment, land use, housing, traffic or much else.  Truthiness - for backers and base to fill in the blanks or the completely uninformed to nod at smiling words that sound like something.

Myths Encinitas

Encinitas has all of the makings to be a creative leader in 21st century measures for resiliency in our natural environment.  The citizenry is leading this effort, the minority voices on the council have long advocated for this and the majority are content to do the minimum and reap the recognition.  Greenwashing is ubiquitous in the power that comes from extraction where profits and private property rights (read: wealth) above all else crew that is or council majority.

Across the nation, across party lines the people are pushing the leaders from the ground up to prioritize the health of the people and the natural world. Clean air, clean and abundant water, less waste, eliminating pesticides, safe food, less carbon and so many other things have touched households - often starting with the children.

It is a myth that doing the bare minimum as a leader means you can call yourself an advocate for the environment.  Case in point is Kristin Gaspar who championed the council majority vote to decimate the environmental work plan that had been created by the Environmental Commission over two years, voted along with the majority for crony on the Environmental Commission over highly qualified applicants, argued for the downtown Farmer's Market to pay higher fees, overturned staff's plans to have General Plan update plans available at the Leucadia Farmer's Market and had a good laugh over safe food issues with her kids drinking juice.  For all her proselytizing from the dais, she has yet to mention climate change realities behind the General Plan Update.  By politicizing density as the only issue, she fosters confusion and fear. This is a smattering of how anti-leadership works with constituents who are misinformed, afraid or simply unaware.

We offer this more recent summary from last Wednesday's meeting:

Agenda item 4 has this in the staff report as background:   "On July 20, 2011, the City Council approved the City’s first Environmental Action Plan designating sixteen key environmental enhancement areas on which to focus. One specific work area was: “Seek recognition through the Institute for Local Government’s Beacon Awards for Encinitas’ current and ongoing efforts to promote sustainability, reduce greenhouse gas emissions, conserve resources and save energy.”"

Staff was doing what Council had asked, and following through on the Environmental Action Plan.  Unfortunately, Donna Westbrook pulled the item from the consent agenda and made a speech about property rights and how participation in this program means forcing people to all live close together and give up their cars and ride bikes everywhere (said very disparagingly) and eliminate parking and follow an international conspiracy, etc. etc. etc.

Instead of dismissing her comments, there were questions from Council about why we are doing this.  Kristin said that she doesn't hear from people that they want sustainability principles applied and she asked why we are "forcing this" upon our community - people like Encinitas the way it is so why do we need to change.

In a later discussion, Kristin squashed a resolution that would ask the Encinitas rep to the California League of Cities (Jim Bond) to go along with the League's recommended position "The fourth proposed resolution requests consideration of suspension or revision of the California Global Warming Solutions Act (AB 32 of 2006). The City Council has adopted an Environmental Policy and a Climate Action Plan that are both responsive to and consistent with AB 32 goals of greenhouse gas reduction. Staff recommends a “Disapprove” vote on this resolution." and instead gives Bond instruction to "vote his conscience". We can only assume what his conscience will tell him!

Again there were comments from the Council that they don't hear from citizens about environmental issues or a desire to address sustainability. So if we want our elected officials to represent us and our views, we need to speak up and hold them accountable. How shameful to have us backing down from an already weak Environmental Action plan.

Misinformation Minute Launch

The August 22 meeting of the City Council was filled with the usual fact bending, staged exchanges, history revisionism, false assumptions, insubstantial staff reports, outright lies and other standard fare.  Sitting through these without feeling frustration and anger is difficult.  Culling through it all again to capture clips feels like punishment.  So today the clips below capture the essense of falsehoods in a minute.  For seasoned council watchers little more is needed, for people new to the scene it's a taste.

This General Plan Update (GPU) restart process was brought to you by the city council majority's scheme described in a whole series, start  here and here if this is new to you.

Despite community-wide frustration and disappointment coming out of the open houses in New Encinitas, Leucadia, Cardiff-by-the Sea, Old Encinitas and Olivenhain; there were 500 people who attended the 2 big workshops to place dots on maps to communicate where they thought high density housing development should be located.

Now, two months later the agenda item on last Wednesday's meeting included an update on this update process.  One aspect of the evening's deliberations are captured in clips below.  A public speech from Pickering regarding respect for citizen participation and clips of two different responses to the overall public participation in the mapping exercise experience, from Gaspar and from Barth.

The great chorus of voices 500 strong (albeit a few out of towners and overlapping commercial participation stuck in the mix) are a group that must not be placed in a secondary position behind ERAC as the council majority is insisting. It has already been done once, where hundreds and hundreds of community members participated in months and months of workshops and events to only have their voices silenced by Gaspar and the rest of the council majority and community provocateurs and financial players generating fear and discord instead of deliberation and problem solving. In a politically staged process at council and in the press, past community work in the GPU was declared dead under the guise of the monster from Berkley consultant takeover.  Bwaahaaa!  Not again.

Now there seems to be plenty of time and energy towards redlining and exploration of alternatives (a good thing) that for some reason was absolutely not even whispered of last September 14th.  Yes, it does indeed smell badly.  But now there are hundreds more from New Encinitas who are quick studies and dedicated activists working really hard.  Taking time, exploring things could be a real thing in the real world.  Counting on New Encinitas as the sound asleep voter base, little sacks of cash and votes, isn't as surefire as it used to be for the super majority sitting on council and running for election.

Rachelle Collier wrote a wonderful letter in April about this and it is a perfect time for a re-read, especially for the New Encinitas activists.  We are all in this together.

Laughing Stocks

Explain to us exactly what is so delightfully comical about your Deputy Mayor acting out a kind of petulant interruption to the final vote on the long awaited and highly orchestrated event for your many promises to special groups on this momentous Hall park and Moonlight Beach financial package to proceed?  Long sentence that and I apologize.  There are simply dozens of suppositions one could stuff into those several minutes of adults acting like adolescents rather than public leaders.  What the hell . . .?

Don't for a minute think Stocks is laughing with us all.  He laughs at us, believing us stupid, blind and deaf.

This deferential treatment of shiny, smiling Gaspar isn't really new, but it seemed more obvious at this evening's venue despite more than a hundred in the audience and an estimated huge audience online.

Remember the last meeting, June 27 when Gaspar was on vacation? We stared at her empty chair at the end of the meeting when her item was pulled from the consent calendar. Via teleconference she essential challenged City Manager Vina's numbers, staff negotiations, anyone's ability to make a lease decision without her amazing financial acumen? Despite all of the City Manager's figures, Muir's confidence (as fire guy), Teresa's attempt to suggest this as a future agenda item the Deputy Mayor was having none of it. Up to and through the voting she was a petulant brat. She is only too aware that there is a ME in team, despite her hypocritical attack on Barth at that very meeting, saying sanctimoniously there was no I in team.  You can't make this crap up!

The Mayor's and Deputy Mayor's  tête-à-tête is the highlight here. And, Gaspar's demand that her wishes and comfort level be honored DESPITE the majority decision and Stocks ingratiating explanatory contortions to appease her are equally gag worthy.

Oh, and just for context to the first clip, note the more common demeanor of Mayor Jerome Stocks at the very opening, the onset of this Special Encinitas Meeting.

 

Throughout the meeting he cut some people off, allowed others to ramble, censored some, charmed others.  Bully. Crony. Bully Crony. Every Encinitas citizen needs the visceral political experience of attending one of the 9 meetings left before the election.  The opinions are not unanimous - even among us all here.  But the actual meetings, and the actual words and behaviours in the clips are plain enough to see.  Please pass along links to all of our neighbors, coworkers and friends.  We can do so much better for our community than this.  We have such talent and ethical individuals who actually want to serve. 

They're still Terrified of Teresa Barth

They are nothing if not relentless in their goal to completely silence Councilwoman Barth and the large number of voters who she represents. The goal in repeatedly bringing back and attacks on Barth seems to aim at destroying her opportunity to come out of exile as the Encinitas preferred mayor. What the hell scares them so much?  Like clockwork every 6 weeks there is some sort of Stocks led power play, masked as a kind of populist move to legitimatize the selection of mayor as fair and civil. 

Review following 2011 mayor selection evening when people turned their backs as Stocks and Gaspar ensconced themselves in the positions of leadership.  

At February 15, 2012 these two acted in concert to introduce a 2 year mayoral scheme that would make Gaspar mayor. This Mayoral Mambo was out of the blue and thankfully didn't get enough votes from their own team. 

Here is what Teresa Barth said at that meeting.  Even now, five months and two council attempts later to get questions answered by staff go ignored.  This is also revealed in the post that follows this clip.

They're Terrified

It was highly entertaining in these last few days to read all of the comments following Jerome Stocks embarrassing letter in responding to Teresa Barth's letter in Encinitas Patch.   First, it was appropriate for Barth to publish her perspective as her voice on the council is so consistently ignored, dismissed or drowned out by four others of the super majority. On the other hand Jerome Stocks gets his bully pulpit on the dais, control of the agenda, a North County Times (NCT) reporter who acts practically like his publicist and other media focus and framing.

Yet the Stocks letter is a gigantic overreaction to Barth's statement of her experiences.  He and his cronies have treated this woman's minority voice on the council with irrational fear.  What kind of power toppling abilities does she have that motions, agenda item requests, counter arguments, insights from other California cities, advocacy for residents, (even a vote for the mobile home tenants for God's sake) might she bring down for them?  These mighty majority act like theirs is very fragile platform. They may be correct. There are hours of meetings which are pretty fact-free or so orchestrated for confusion it is difficult to mount rational responses. There is not a lot of 'there' there.  We know its been years since anything has been built or accomplished.  Even the General Plan Update (GPU) is being sold as a hoax by the council who brought it to life.

Undeniably there is a great deal of money behind these big boys.  Nobody needs to be told that, although it would be helpful if we could be reading in the press the names behind those who back this cabal at city hall.  It is well past time for that preliminary investigation.

Yet, these comments in the letters here and here are a wonderful sign that there are so many articulate, informed and savvy people paying close attention to these (mental and emotional) lumbering brutes who think the city is theirs and the inhabitants are all asleep or imbeciles.  Wide awake comments at NCT's, A"So Much For Democracy" Raspberry discussion thread brought another batch of insight and resistance, though the regular majority's gang were still there crying about that mean (how dare she) Barth and anyone who would attack poor Stocks and Co.

If you wrote a comment speaking out for Barth, against the Crony Club - give yourself a pat on the back.  Several comments were inexplicably deleted.  I hope they might be recovered as they belonged with the rest.  Imagine if 40 people responded rapidly to an engaging story for challengers to the monopoly or to a hit piece.  This would be a revitalized, engaged community before the election was even under way.

Lisa Shaffer published her statement prior to the this March 28 meeting and EYNU captured it. And Tony Kranz spoke out at this meeting with his own unique experience and perspective on the faux populist and criteria arguments.

Wed. night - Now 16 weeks later (whoops their skipped opportunities). This winner take all crowd in the majority again can waste time - supposedly on the people's business - to distract and abuse the public on this political attempt to garner complete control of the city council process in Encinitas.

This ordinance is STILL poorly written, still without answering repeated questions for more detail and still politically driven, and not much more. Nothing is broken here, it's fixed. The personal grudges of this majority are frightening in their relentlessness and viciousness. What do they fear? And a special note to the old guy who has vowed to bow out and vowed to change the mayoral selection to an elected option. Sometimes you just don't get what you want. Please let go of your grudge from years ago. You and Muir can take the higher ground.

Myths Encinitas - People's business continued . . .

This week's second major myth is that this council majority primary interest is to conduct the people's business.  This is a continuation of Monday's Myths Encinitas.  The Deputy Mayor, in her role as Gaspar the Willing Host (variant of Casper the Friendly Ghost, a favorite here at Our Mayor and Gaspar the Empty Boast) again shows she is more than willing to be the presenter or hostess on behalf of the cronies. This includes the majority team and the people they are serving - a very short list who will benefit directly from an unchallenged status quo in all things. 

A subcommittee set of constraints is just the latest in the council administration policies being reshaped and rewritten over the last few years to keep the public tightly controlled and gagged if possible. But for context, it is important to show a whole series of acts to waste the people's time, the public's money for staged antics to silence dissent, marginalize minority decisions and control outcome at council meetings. All of these things are to codify, make legal, injustice and bullying behavior of the majority. Hours and hours of council time, public backlash, council "deliberations" (read: rationalization) is used to create controversy and confusion.  People's Business my ass - that is a joke.

This subcommittee business started with the strategy to take the offensive with a big emotional topic to mine votes in the upcoming election year  - the General Plan Update.  September Stocks ranted and raved fact free for about a minute and a half. His rudeness and ugly baby image gave the trigger point for, step 2 the outraged citizenry / businessmen. The next step was to position Kristin Gaspar to present the scripted plan to introduce a new council advisory body.  What followed this elaborate attack on the General Plan process was volunteering Teresa Barth to sit on a subcommittee with Gaspar to flesh out this newly scripted plan as the video clip below shows. 

Subcommittee Ambush for Super majority Goal. 

Just 2 weeks later the majority volunteers Teresa Barth to the subcommittee appointed to decide how to fill Maggie Houlihan's seat despite Maggie's videotaped wish that Lisa Shaffer be considered her successor and many public speakers questioning why the next highest vote getter at the last election, Tony Kranz.  Barth was clearly in favor of either of these options, yet she was ambushed again into legitimatizing the majority nonsense. We are to infer (or to read in minutes) that Barth was a full and equal member of the subcommittee. What do you think? 



 Back to the General Plan Blow Up offensive plan where Councilwoman Barth was roped into being a volunteer on the ERAC subcommittee meeting.  In this tirade by Councilwoman Gaspar which was illegally allowed to be presented by Mayor Bond as an non-agendized speech, unchallenged by the city attorney, unanticipated by Barth and on top of all that . . . Bond disallowed any rebuttal from Barth.  This is an ambush, an attack clear and simple.



By this time it was clear that Barth was being set up to appear as a traitor to the Maggie Houlihan constituents, unworthy as a potential mayor (with that procedure coming up soon) and virtually silenced to present her own case or mount an effective counter balance to an all-consuming super majority.  Teresa Barth remained and continues to hold stead as a community treasure in the eyes of the public  - despite these attacks. 

Over a period of a few critical weeks at the end of 2011 the people's business was ignored in favor of blowing up General Plan Update and creating a super majority on the city council. They also were able to kick Teresa Barth to the curb when selecting a new mayor based on fabricated nonsense from Gaspar's she-said, she-said presentation of undocumented subcommittee work.

On March 21 of this year Teresa Barth was able to make it clear she would no longer serve on any subcommittee until rules and responsibilities were spelled out.



And six months since later this super committee have codified a gag rule that completely keeps the people's business in secret.

This majority gang will never be accused of serving the peoples business or being critical thinkers or creative in their governance of Encinitas for the good of the whole population.  They are relentless though in their inventive winner take all strategies via disinformation, distraction and denial - if you'll excuse the alliteration. Again, making the claim of doing the people's business is comically stretching the truth.

Myths Encinitas

The most glaring myth lately (first of several) involves the Gaspar Gag Order passed at the last city council meeting by the majority. In essence these new procedures codify "secret meetings" and require "group-think" to be considered a good team player.  This is a complete myth.  A good team player provides his or her unique flexibility,  skills, strengths and insights to strengthen a team.

Another aspect of this myth of a good team player is the completely fabricated outrage to justify unacceptable behavior in ambushing and attacking Councilwoman Barth last fall.  Siince that abusive period Barth has refused any and all appointments to a subcommittee until rules are clarified.  This was to be that meeting and instead it was a bunch of bullies ganging up on her, ganging up on the public with the blessing of the city attorney and city manager. Go team evil.
 
And this myth begets more myths, like the mythical allegiance a good team member must provide to her attackers.  Throughout the 30 minutes of this agenda item #8 discussion the crony club that is our city council majority ignores public speakers, revises history, makes things up, redefines language, creates false choices, welcomes straw men and a whole fustercluck of cruel, condescending and dismissive silencing of Teresa Barth and the thousands and thousands she represents.  It's legal, but team evil is the only game in town right now. Imagine for one moment you are a lone voice attempting to be heard as an equal team player even though you have a different opinion or perspective and moreover, you have alternatives for the team to consider. Most importantly, Barth points out that it is a mistake to consider the city council as the team when the focus should be on the public with the council being part of that team.

If you can sit through all of the next two clips, you might try to listen to how language is used, how sources are lacking and other critical elements citizens should expect from a deliberative governing body are completely missing.

It is really difficult to witness or listen to authoritarian language of absolute control presented with childish clichés in a tone of condescension from a neophyte like Kristin Gaspar.

• All discussions involving city staff will happen within an ad hoc committee setting. 
• The ad hoc committee will sign off on the staff report before it’s brought back to council.
• The ad hoc committee will only address topics discussed by the full council. 

Mayor Stocks wanted to slap on even tighter control with mandating the mayor alone being able to appoint subcommittees and name the chair.

The pile on doesn't end with the vote of 4:1.  Barth attempts to at least allow the guidelines to come back as an agenda item.  Not a chance.

Following this meeting Teresa Barth stated,

"I have served on a number of subcommittees during my past 6 years on council, including a committee with Jerome Stocks concerning former city manager Phil Cotton's compensation. Mr. Stocks recommended a significant raise and I recommended no raise. I have never received a complaint from any other council member nor have I complained about their comments or suggestions in the sub-committee process. Deputy Mayor Gaspar seems to believe that disagreement and independent research are somehow inappropriate.

Councilman Bond also commented about the need to "get things" done and having the public included slows things down.

Open Meeting laws (the Brown Act) do not apply to temporary sub-committees as long as there is not a quorum of elected officials on the committee. However, in light of the recent actions and comments by other council members, I believe the public should have the right to attend such meetings if they so desire. I proposed simple procedures that would have allowed the public to attend subcommittee meetings. The Council majority didn't agree."

Tomorrow there will be a second installment of this myth.  It is born out of the misuse of the phrase, people's business as a council responsibility.

Today's Perfect Image

In Encinitas, in our council chambers, we know the kind of sulking child-like public 'servants' . . . yes, we do.  Last night's meeting's last half hour was filled with childish foot stamping intransigence. Gaspar's pout wasn't just tolerated, it was indulged. Gag.  Clips will come when we can find someone to suffer through the process of preparing it for submission.

All or Nothing

It's the ugliness of bullies taunting because they can, not because they gain anything of value from it except admiration from other bullies. How else to describe taking something simple and basic and turning it into mocking, marginalizing or silencing?

Encinitas super majority council headed by Mayor Stocks and Deputy Mayor Gaspar continually show their unwillingness to act on behalf of the entire community.  They don't just speak, vote and act on behalf of their backers in the community and outside the community, they silence other opinions and attack dissenting views.

During the Norby contract deliberations Councilman Bond was determined to play his assigned role of distraction and confusion as he trotted out baloney like this gem, "If you happen to be someone who supports the direction of the council you are special interests." This was part of a 7.5 minutes of reductive muddled opinions from a man who claimed his old bladder needed to be emptied.  After the break for Bond to pee, Stocks allowed the public speaker, Tony Kranz his 3 minutes at the very end of the meeting. Again, bully behavior defended at the last meeting with Stocks self-righteous speechifying about the distraction from the "people's business" of agenda items in favor of oral communications minutes.

And by the way, none of the super majority will tolerate any criticism from the public. This meeting had several speakers who confronted the council (Stocks in particular) and Norby. This was not handled with any grace or tolerance from the majority (Stocks in particular). All or nothing.

Art Banner Auction - A Tribute in Spite of the Mayor and Deputy Mayor

The Arts Alive Banners will be auctioned Sunday!

The colorful banners, designed by artists throughout the region and the world, will go to auction starting at 2 p.m. Sunday in the Courtyard at Cardiff Town Center, at the corner of San Elijo Road and Birmingham Drive. The minimum bid for a banner is $150, with proceeds shared between the artists and arts organizations 101 Artists Colony, Cardiff 101 and Leucadia 101. What a battle it has been to allow Maggie Houlihan, a friend to the artists of Encinitas prior to her death last fall, to be honored and remembered through this civic project.

At this last May 16 city council meeting, Gaspar the rigid post, was unbending in her self-supporting stance regarding the her accusatory words and behavior towards the Artist 101 Colony director, Danny Salzhander on April 11 this year. After Danny and most all of the previously packed council chamber were long gone and most watching at home had, like this editor, clicked off the meeting, when the Deputy Mayor offered her explanation of her conduct just minutes before the close of the meeting.

Fake Apologies and How to Recognize Them

• While a true apology shows concern for the receiver, many fake apologies begin with "I'm sorry" but end with a point that is completely incompatible with remorse: {You're reading
• Standing by what you did is not remorse, therefore not an apology.
• Demanding to be forgiven is self-serving. A good general formula to help you recognize non-apologies is "If it's self-serving, it's not an apology."
• Changing the subject is not an apology: "Well, what about what you did?" Changing the subject indicates an unwillingness to apologize.
• Verbal abusers often show resistance to apologizing. Continuing to insist that what you've done was not verbal abuse somehow, or that verbal abuse is somehow not wrong, or that Wrong is somehow relative -- that's not an apology. The point of apologizing is not to say that the crime still feels reasonable to you.
• "I'm sorry but ____" is not an apology, because it does not communicate an understanding that you did wrong.
• Any blaming of the receiver's perceptions: "I'm sorry you perceived that I ____." Calling someone delusional is a tactic, not an apology.
• "You misunderstood." Pretending that your words didn't mean what they mean, i.e. pretending that your words don't have literal meaning, is not an apology.
• "I'm sorry you misunderstood" is a more blatant, in-your-face form. Most often, when someone says "I'm sorry you misunderstood," neither is true.
• Calling the receiver "ungrateful" for not instantly forgiving. In general, calling the receiver ethically defective, perceptually defective, etc., are not apologies, but are forms of gaslighting.
• "But I didn't do it on purpose!" The universal excuse of good intentions isn't an apology; it's an excuse for doing more of the same, for continuing to offend. It's a childish belief that one can continue acting in a hurtful way as long as there is some nebulous "good intention" involved. Hitler apologists like to make use of this one, often in the form "He was only doing what he thought was best for his country, and that's not so evil, is it?" Yes, in fact, it is. Don't be taken in by excuses that look at the problem through the wrong end of the binoculars. Any offense can be described from such a high level that the problematic details conveniently disappear. But the motive behind the search for such a viewpoint isn't really remorse, is it? Saying "I don't see the connection between my actions and your reaction" is not an apology. It's a denial of responsibility. It's a suggestion that the hearer overreacted.
• "I'm sorry [but] you ____" is not an apology. It's a blame-shift.
• "I'm sorry you got all offended" is not an apology. It's a slap. It's a technique for adding insult to injury.
• "I'm sorry you feel that way" is not an apology.
• "I want to apologize" is no more an apology than "I want to lose weight" is a diet.
• "I'm sorry about what happened" is not an apology, any more than saying "I hate when that happens." ;^) When someone says "I'm sorry about what happened," consider answering, "And...what was that, exactly? I'd just like to be sure we're on the same page." People have been known to completely miss the point and apologize for the wrong thing.
• Variant: "I regret that it happened." Referring to one's actions as "what happened" is not an apology because the speaker is not taking responsibility. There are two kinds of phenomena: those which "just happen" (earthquakes, tornadoes, old trees falling down in the wind) and things which are caused by deliberate, chosen actions (like the house damaged by a tree which falls when a drunk driver collides with it). Of course, the drunk driver will usually claim "It was an accident," as if to say "I wasn't the cause." This is merely propaganda, designed to trick the gullible.
• "I'm sorry for what I did" is an improvement. Still, it leaves things unsaid; it doesn't specify what the speaker did, perhaps even conceals it on purpose, perhaps because the speaker doesn't understand or agree that what he/she did was wrong. What a pronoun is to a noun, this statement is to an apology. A complete apology is not vague; it doesn't say "I'm sorry about...that thing I did." If the parties don't agree as to the nature of the error, they don't agree as to the meaning of the apology. The promise inherent in the apology has been left blurry.
• One sometimes sees this method used between nations. The thought process seems to be, "How small an apology can I offer while still causing the receiver to think I feel remorse?"
• There are other ways of distancing oneself from responsibility. "That's in the past" is an assertion that the passage of time is a substitute for an apology. It's a suggestion that one is entitled to hurt others as long as no one notices for a very long time.
• "We've both said unfortunate things" is not an apology. It's an accusation. It's inflammatory. It's an attempt to shift the spotlight.
• "I'm sorry about that. And now, isn't there something you'd like to say to me?" An apology is not a quid pro quo -- reciprocation is not required, unless wrongdoing occurred in both directions. But if not, only an uncivilized person would apologize to you as a way of forcing an apology out of you.
• Deathbed apologies are not necessarily real. Real apologies are not triggered by intense emotions or deadlines or expediency. True apologies are motivated by "I'm sorry for what I did," not "I'm sorry we weren't close, I wish I could figure out why we weren't."
• "Of course I'm sorry" contains just a hint of annoyance. It's a bit like saying "Am I sorry? What a silly question. What are you, stupid?"

Myths Encinitas

Being a young woman, a mother, nurturing, married to a health professional means a woman plays a role as a public-friendly, health conscious community servant.  Mythical gender fantasies and stereotypical roles are assumptions born out of a media/ad culture. Don't you believe it.  Encinitas' very own poster girl for Myths Encinitas is Kristin Gaspar.

When it comes to family health and quality of life and community common good issues, follow the money. With the possible exception of her own personal home (unknown), if there is no way to subsidize funding or there is no direct benefit to the crony club of financial backers, political players Ms. Gaspar will find a way reject a proposal, idea, ordinance or code recommendation. Bike lanes, walking routes connecting the whole community, public health or farmer's markets all are scrutinized even when there is no direct cost to the city.

Gaspar and her mentor (who is said to live in Oceanside, not Encinitas) are making arguments outside of reality and measurable facts. Myths Encinitas is a growing phenomenon amongst the council majority and, by extension, the planning staff. Compare the things said by Gaspar and her friend claim alongside that of Carlsbad, beloved of the Council Majority in their example of big rich growth.  Even this city has the political will to recognize a healthy, happy citizen (visitor & tourist) community is worth planning and paying to achieve. They understand that even for businesses 'sustainable' means thriving, prospering, staying alive, not dying - not alien takeover - or commercial threat. Seriously, what is the opposite of sustainablility but death and ruin? It makes no sense to demonize quality, health, prosperity and community or say it costs too much unless one is directed to do so.  The cost is far too high to refuse to address and budget for a sustainable future.

On a really serious note directly related to dangerous gender politics, Myths Encinitas Gaspar is doing a serious disservice to the women of all ages in Encinitas. Women across this country are under attack and losing choices, health care, support and safety in their own homes.  Shockingly the House just passed a version of the Violence Against Women Act  that would let domestic abusers know their victims called for help. The politically driven war on women is a time when those women who hold offices from those in the highest seats of power down to the local level could choose to speak and act on behalf of half the population in a crucially supportive way or choose to support a few powerful men with money.
